Showwcase Copyright Dispute Policy

We have prepared a copyright dispute policy in accordance with the Digital Millennium Copyright Act ("DMCA") to address copyright infringement. We reserve the right to (1) block access to or remove material that we believe in good faith to be copyrighted material that has been illegally copied and distributed by any of our advertisers, affiliates, content providers, members or users and (2) remove and discontinue service to repeat offenders.

Your use of the Site, whether as a content creator, consumer (including a paying or non-paying subscriber) or otherwise, is subject to the Terms of Use https://about.showwcase.com, which incorporates this Copyright Dispute Policy. Any terms that are used in this document without defining them have the same definitions given to them in the Terms of Use. We reserve the right to revise this policy from time to time at our sole and absolute discretion with or without notice.

How to Report Copyright Infringements

  1. Please send a notice of copyright infringement with the following information to Showwcase’s Designated Agent to Receive Notification of Claimed Infringement (our "Designated Agent", whose contact details are listed below) if you believe that material or content residing on or accessible through the Services violates your copyright (or the copyright of someone whom you are authorized to act on behalf of)

    • A physical or electronic signature of an individual authorized to act on behalf of the owner of the copyright that has been allegedly infringed;

    • Identification of copyrighted works or material allegedly being infringed;

    • Identification of the works or material that is claimed to be infringing including information about the location of the infringing works or materials that the copyright owner wants to have removed, with sufficient details so that Showwcase is able to find and verify its existence;

    • The notifier’s contact information including address, telephone number and email address (if applicable);

    • The notifier’s good faith belief statement that the works or materials identified in (1)(c) has not been authorized by the rightful copyright owner, its agent/representative, or the law; and

    • The notifier’s statement made under penalty of perjury that the information provided is accurate and that the notifier is authorized to make the complaint on behalf of the rightful copyright owner.

  2. By submitting a copyright infringement claim to us, you agree that you shall be liable for and indemnify us against any loss, damages, costs or expenses incurred by us or our users as a result of or in connection with your misrepresentation if you knowingly materially misrepresent that a person/organisation or an activity infringes your copyright (or the copyright of someone whom you are authorized to act on behalf of).

Receipt of Infringement Notification by the Designated Agent

  1. Upon receipt of a proper notice of copyright infringement, we reserve the right to

    • forward a redacted copy of your complaint or notice of copyright infringement to the reported content provider and/or affected user(s), with your personal information removed;

    • remove or disable access to the infringing material;

    • notify the content provider who is accused of infringement that we have removed or disabled access to the applicable material; and

    • terminate such content provider's access to the Services if he or she is a repeat offender.

  2. We may take into account any retractions and counter-notices prior to taking any remedial action against the reported content provider.

How to Send a Counter-Notice to the Designated Agent

  1. The content provider may send us a counter-notice containing the following information to the Designated Agent if the content provider believes that the material that was removed (or to which access was disabled) is not infringing, or the content provider believes that it has the right to post and use such material from the copyright owner, the copyright owner's agent/representative, or, pursuant to the law:

    • A physical or electronic signature of the content provider;

    • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled;

    • The content provider’s good faith belief statement that the material was removed or disabled due to mistake or misidentification of the material; and

    • The content provider's name, address, telephone number, and email address (if applicable), and a statement that such individual or entity consents to the jurisdiction of the Federal Court for the judicial district in which the content provider’s address is located, or, if the content; provider's address is located outside the United States, for any judicial district in which Showwcase is located, and that such individual or entity will accept service of process from the individual who filed notification of the alleged infringement.

  2. If a counter-notice is received by the Designated Agent, we may, in our discretion, send a copy of the counter-notice (with the contact information submitted in the counter-notice) to the original complaining party informing that individual that we may replace the removed material or cease disabling it in 10 business days. Unless we receive written notice from the copyright owner or its duly authorised persons that the copyright owner files an action seeking a court order against the content provider accused of committing infringement, the removed material may be replaced or access to it restored in 10 to 14 business days or more after receipt of the counter-notice, at our sole and absolute discretion.
